The University of Houston’s Department of Public Health was criticized Wednesday for its failure to make public the impact of a proposal that would require all private-sector workers to submit written health plans that comply with federal law that would prohibit employers from discriminating against health care providers through employer-based health insurance.

In a letter to the Office of Legislative Ethics, the UH Department of Health and Human Services said it has a continual obligation to ensure that the policy does not make employers or their employees liable for employee insurance claims.

The letter was sent by UH’s Office of General Counsel Robert Voss, who represents the university’s Health Services Division and the university’s Health Science and Human Services Division. A copy of the letter was not returned.

The University of Houston, which operates several health-care providers, is required to disclose certain information to the Ethics Committee once a health care provider files a claim against its health insurer or is seeking to acquire health care services. All employers have the right to exempt their employers from the requirement.

The letter said the University of Houston has not made a decision on whether to include an employer-sponsored health plan in those plans. A request to see the final report from the ethics committee, which was made by Houston’s Office of General Counsel Michael P. D. Kukowski, was not immediately returned Tuesday.

In that request, the company said it would not be liable for an employee’s participation in a health-care plan. In an interview on Tuesday, John Tannenbaum, general counsel for the university, said, We think there are some situations in which we would get to the point where we might actually get to the point where we are willing to do something, but that might not be the case on health care insurance,
